November 6th, 2018
Tonight’s Council Meeting started off with a few items discussed in Executive Session. Afterward, several of the items dealt with Plans and Projects getting Council’s final approval to move forward. There is always a great deal going on in the city both visible and “some not so visible”. Willoughby is moving forward in a stable and positive direction. At times it may seem like everything is “moving at a snail’s pace” but we need to make sure that the details are attended to and what is happening is in the best interest of the city and its residents.
SPECIAL MEETING/EXECUTIVE SESSION*
This Executive Session was held @ 7:00 pm
• *The purpose of the Special Council/Executive Session in accordance with ORC 121.22 (G) 3 is to discuss pending litigation.
COMMITTEE MEETINGS
• Finance Committee Meeting
The purpose of the Finance Committee Meeting was to discuss:
· Health Insurance
o The discussion centered around the renewal of the Health Care Plans for the City. Two speakers from the Fidelity Group shared that according to their "shopping" for the best deal, the City will face, BELIEVE IT OR NOT, NO insurance increases and even a decline in premiums for Dental and Vision. GOOD NEWS FOR THE CITY.
COMMITTEE REPORTS
· No committee reports this evening
LEGISLATIVE CAUCUS
• The general purpose of the Legislative Caucus meeting is to review and discuss the legislation on the Regular Council.
CORRESPONDENCE
· The only correspondence dealt with was a Liquor License Transfer.
o Council requested more research to be conducted on this particular transfer due to lack of clarity in its presentation.
PUBLIC HEARING
· It was shared to Council that there will be a 100th-year celebration of the END of WWII. There will be several activities held at the American Legion Hall off Center Street.
· The same resident spoke on the topic of the proposed Housing Development to go up in Willoughby and Mentor called Ridgewood Acres. He shared how Mentor approved the plans but with many conditions. We, the City of Willoughby assured the resident that all these conditions would be looked at and that we would be setting our own requirements prior to the approval of this project.

NEW BUSINESS
· ORDINANCE NO. 2018-129
· An ordinance authorizing the acceptance of the Sidewalk Construction Escrow Account Agreement between the City of Willoughby and On the Greens Development, LLC for Fairway Glenn Subdivision Phase II.
· WHEREAS, On the Greens Development, LLC ("OGD") as Developer, is required to complete sidewalk installation within the Fairway Glenn Subdivision - Phase II; and
· WHEREAS, OGD has requested the City to enter into an agreement for the construction of sidewalks in accordance with Codified Ordinance 1111.0S(e), which request is acceptable to the City; and
· WHEREAS, the City Engineer has estimated the cost of the total amount for sidewalk installation in Fairway Glenn Subdivision Phase II to be $107,980;
· This Ordinance puts into enforces a Willoughby policy whereby a developer must put into an escrow account the funds to have installed the sidewalks for their development. In the past developers “beat the system” and got away with not putting in promised sidewalks. This plan assures that will not happen.
· ORDINANCE NO. 2018-130
· An ordinance accepting the Final Plat for Fairway Glenn Subdivision Phase II.
· Berardino Palmieri, Managing Member, On the Greens Development, LLC, has filed the Final Plat of Fairway Glenn Subdivision Phase II ("Final Plat") with the Planning Commission of the City of Willoughby, Ohio, and has requested approval thereof; and
· WHEREAS, the Planning Commission and the City Engineer have reviewed and approved the Final Plat and the City Engineer has further certified saidapproval.
· The plats for this project have been approved by Council, Planning Commission, City Engineers, and our Legal Counsel.
Some discussion centered around a proposed traffic signal for the intersection of Lost Nation Road and Hodgson Road.
The city is negotiating with:
· The Airport (Lake County Ohio Port & Economic Development Authority)
· The Developer
· Possibly NOACA
to aid in the financing of such a traffic signal. The cost of a signal at this location is approximately “double” what a traditional signal would cost. This is due to the location to the Airport and its runway path.
We are also looking at possibly setting up and an escrow account to have the monies from the developer held so there is accountability to the project.
· RESOLUTION NO. 2018-131
· A resolution approving Change Order No. 1 in the 2018 Concrete Pavement Repair Program - Contract B with T.C. Construction Co., Inc.,.
· SECTION 1. That Change Order No. 1, increasing the contract amount in the 2018 Concrete Pavement Repair Program - Contract B with T.C. Construction Co., Inc., a copy of which is attached hereto, is hereby approved in accordance with the recommendation of the City Engineer, and to that extent, said Contract is amended.

This large increase in cost was attributed to several factors.
· Additional repairs that were necessary to take care of
· Problems with asphalt repairs where the concrete sub-surface needed to be replaced before the asphalt repairs were applied.
· RESOLUTION NO. 2018-132
· A resolution authorizing the Mayor to enter into a settlement agreement and release of all claims and demands with William R. Gray Associates, Inc. relative to all pending or potential litigation between the City of Willoughby and William R. Gray Associates, Inc.
· That the Mayor is hereby authorized to enter into a Settlement Agreement and Releaseofallclaims anddemandswithWilliamR.GrayAssociates,Inc.relativetoallpending orpotentiallitigationbetweentheCityofWilloughbyandWilliamR.GrayAssociates,Inc.;said Agreement/ReleasesubstantiallyintheformnowonfileintheLawDepartment.
· This all relates to the Riverside Commons site off Lost Nation Road.
The parcel has sat empty since 2006 due to legal issues.
· RESOLUTION NO. 2018-133
· A resolution approving EAS #13-9-18 for construction of an addition to the existing building located at 3872 Erie Street (Spirits in Willoughby). This is the EAS approval for a new Kitchen Area to be built on site for Spirits of Willoughby. The kitchen will serve the business needs BUT NOT act as a full-scale restaurant.
· RESOLUTION NO. 2018-134
· A resolution approving EAS #14-9-18 for construction of an addition to the existing building located at 38408 Apollo Parkway (Severino Construction).
· SECTION 1. That the application submitted by Joe Myers, Architect, for construction of an addition to the existing building located at 38408 Apollo Parkway (Severino Construction) is approved, and the Council hereby determines that, based on environmental considerations, such project shall be allowed to commence or be constructed subject to compliance with all applicable ordinances and regulations of the City of Willoughby and statutes of the State of Ohio.
REPORTS FROM THE DIRECTORS, MAYOR, AND COUNCIL MEMBERS
• MAYOR
· The mayor shared that next week, City Council and the Planning Commission will return to work completing the edits to the current Zoning and Planning Code Book.
· JUDEAN BANKER, RECREATION DIRECTOR
· Judean shared that the Recreation Department received a grant recently for the amount of $35,160 which will help to cover the cost of the Fitness Equipment to be installed at Osborne Park spring/summer 2019.
· Judean also shared all the events that will take place over the Holidays.
· Get into the holiday spirit and join us in Downtown Willoughby for the annual Holiday Lighting Celebration on Thursday, November 29th at 7 pm.
· Before the main event, enjoy sounds of the season from Edison Elementary 3rd graders, South High choir and the South Rebels Marching Band. Santa will also be coming to town for the season!
· Also, that evening, a Live Nativity, sponsored by Willoughby United Methodist Church starting at 6 pm and the 26th annual Evening Lions Holiday Auction downstairs of City Hall to benefit the Lions Eye Care Program and community service projects.

QUESTIONS & COMMENTS BY COUNCILMAN KARY
· This evening, I addressed Council and the Administration on my strong support regarding the investment in several “TRAFFIC CALMING DEVICES”. This has been a topic for Council for well over a year and a half, and I wanted to be sure we were moving forward to address this issue. Some of the points I made were:
o We are all in agreement that speeding is a major issue in the city
o We also all agree that there are several solutions to deal with the problem
More police surveillance
A speed limit signs with an "odd" number (31 MPH)
Striping streets narrower
Flashing Speed Limit Signs
o There is data to support that the Flashing Speed Limit Signs do work
o We also have support for this technology by the City Engineer and the Police Department
o The PLAN now is to find the funding. Then, after creating the specific criteria and standards that would warrant a Traffic Calming Device select the first locations for installation.
o The locations may be temporary at first then the possibility would be for a permanent location in areas where they seem the most effective.
