ENVIRONMENTAL PLANNING COMMITTEE MEETING:

EAS #14-10-24
Interior modifications of the existing building located at 4734 Topps Industrial Parkway (RPL Holdings LLC).
Mr. Collins stated he owns Moving Ahead Services and has two buildings on Topps Industrial Parkway. He runs the City of Kirtland’s baseball program so he had batting cages at the building for training. There was a pickleball court and work out area for the employees which morphed into an opportunity to cover some costs. He created Willoughby Pickleball and it is being rented out with secure access. Mr. Kary stated that the business was up and running and somehow someone from the City told them they needed a CUP, an EAS and a development plan. Mr. Collins didn’t realize he needed the permit. Mr. Kary stated a lot of what’s reviewed in an EAS is not applicable to this one because the permit is for the inside of the building. There were no issues regarding stormwater, noise, water or air pollution, impact on the schools or hazardous waste. Mr. Collins stated he will begin operating immediately when approved. The pickleball courts will be running during the evening hours so there won’t be any parking or traffic issues.
There were no other comments or concerns.
Mr. Kary stated the committee is recommending to Council the passage of EAS #14-10-24.

STANDING AND REGULAR COMMITTEE REPORTS
Parks & Recreation Committee, Ms. Sievers – Regarding the Euclid Avenue plan, Ms. Sievers stated that Economic Development is working with Brandstetter to prepare a survey for the residents; they are hoping to add it to the website in January, 2025. Another meeting with Council will happen shortly thereafter.

NEW BUSINESS
RESOLUTION NO. 2024-120 Motion carried 7-0
A resolution authorizing the Mayor to accept a One-Time Strategic Community Investment Grant from the State of Ohio through the Ohio Office of Budget and Management (OBM) to provide financial assistance for the Osborne Park Erosion Control Phase 1 Project, and declaring an emergency.
Mr. Carr stated this is a formality to accept the grant.
RESOLUTION NO. 2024-121 Motion carried 7-0
A resolution authorizing the Mayor to enter into a contract with Fabrizi Trucking & Paving Co., Inc. in the amount of $2,187,059.00 for implementation of the River Street Waterline Replacement and Soil Stabilization Project, and declaring an emergency.
Mr. Carr stated that according to an e-mail sent out by Mr. Lannon, this contract amount was far below the estimate. Mr. Lannon stated there were five bidders for the work to start early next year. The cost split between the county and the City was important, and it worked out well. Mr. Carr asked if Fabrizi received the county contract as well. Mr. Lannon stated that it is one contract for management purposes. Regarding the timing, Mr. Lannon stated it would take a while to execute the contracts and approve submittals. Watermain work typically starts in late February. There is no reason the wall can’t start at the same time; there will be a lot of preparation work followed by holes being drilled and filled with concrete. Mr. Carr asked about the road closures and the impact on residents. Mr. Lannon stated it’s up to the contractor to figure out road closures; he stated there is a potential 60-day closure. The road can be open during water main work, but it will need to be closed during the wall work. Mr. Carr asked if the City could get information out to residents via the website and Facebook.
RESOLUTION NO. 2024-122 Motion carried 7-0
A resolution approving EAS #14-10-24 for interior modifications of the existing building located at 4734Topps Industrial Parkway (RPL Holdings LLC).
RESOLUTION NO. 2024-123 Motion carried 7-0
A resolution amending Resolution No. 2024-39 to provide for current expenses and other expenditures of the City of Willoughby, Ohio, during the period ending December 31, 2024, anddeclaring an emergency.
These are minor changes to the appropriations. Ms. Hoffman stated she didn’t have budgeted the county portion of the Fabrizi contract which is the largest increase.
RESOLUTION NO. 2024-124 Motion carried 7-0
A resolution authorizing the Mayor to enter into an agreement with Motorola Solutions, Inc. through the State of Ohio Cooperative Purchasing Program in the amount of $529,182.46 for the purchase of Motorola Radios necessary to the operation of the Willoughby Fire Department and declaring an emergency.
Chief Ungar stated this resolution allows the Mayor to enter into an agreement with Motorola Solutions for the purchase of the radios.
ADDENDUM
RESOLUTION NO. 2024-125 Motion carried 7-0
A resolution approving Change Order No. 1-Final in the Hartford Road Watermain and Water Pollution Control Center Watermain Improvements Project, and declaring an emergency.
Mr. Lannon stated this project worked out a lot better than expected. Due to the massive change order due to ground water conditions for the WPCC enhancement project changes were made for this project. Instead of coming off Erie Road into the plant driveway and crossing under Corporation Creek, he decided to come off of Lakeshore Boulevard on Hartford next to the marina. The ground conditions were much better. He accounted for ground water in the bid, the contractor did their homework and even went to an expert in Michigan and ended up bidding only a couple thousand dollars for dealing with ground water. He credited Davis Diggers for doing their homework. Their bid was a lot lower than the other bidders which made him nervous but it all worked out in the end. Mr. Lannon stated the deduction on the change order was for resurfacing Hartford that wasn’t as bad as originally thought. There was a $6,000 charge for dewatering that wasn’t used at all. The only issue was a buried stump that had to be removed on Hartford Road.
RESOLUTION NO. 2024-126 Motion carried 7-0
A resolution authorizing the Mayor to enter into a Memorandum of Understanding with the Lake County Department of Utilities for various utility road repair projects to be implemented and included in the 2024 Pavement Repair Program, and declaring an emergency.
RESOLUTION NO. 2024-127 Motion carried 7-0
A resolution approving Change Order No. 1-Final in the 2024 Pavement Repair Program with Cole Burton Contractors, LLC, and declaring an emergency.
Mr. Lannon stated there was a significant deduction in the original City contract of over $100,000, which is very similar to last year. This also adds in the county’s work at $150,000; but the City’s portion is a deduction of over $100,000. He expects the 2025 road repair program money will go to the Rt. 84 retaining wall and the River Street resurfacing which will be over $1 million.

MAYORS REPORT
Mayor Fiala thanked Council for the confirmation of Tom Roseum. He stated he will have another appointment for the Public Art Committee at the next meeting; Jessy Barbarich has resigned. Mr. Anderson asked if he could find out what’s going on with the restaurants that have closed recently i.e., Dukes and Boots and Pulpa? Mayor Fiala stated he recently started meeting again with the Willoughby Bar and Restaurant Association so he will get a report by the next Council meeting.
DIRECTOR’S REPORTS
Fire Chief Ungar – Chief Ungar thanked Council for the passage of Resolution No. 2024-124. Chief Ungar stated the Fire Department responded to an incident at the mini storage facility on Euclid Avenue. He stated someone had left a charcoal grill inside one of the storage units which created a smoke condition, however, on a social media page it was posted there was a big shoot out with Police. He stated that information was incorrect; there was no shoot out.
Parks & Recreation Director Keller – Reported there was a pre-bid field visit today for the Chagrin River Floodplain and Trail Project. She stated that 14 companies requested the RFP which comprised of 3 groups (14 companies working in 3 groups). She stated this Thursday there will be a pre-bid meeting for the Osborne Erosion Project; 10 packets have been requested. Legislation for both projects could be before Council in December.
Finance Director Hoffman – Ms. Hoffman thanked Council for the passage of Resolution No. 2024-123.
