Willoughby City Council Meeting Summary Notes
February 19th, 2019
Tonight’s Council Meeting was a chance for Vice President, Bob Harrold to run the meeting. Councilman Harrold did an excellent job with "no hiccups". Congrats Mr. Harrold. Also note that Councilman Harrold will be ending his service as a Councilman for the city this year, as he decides it is time to retire and spend more time with his lovely wife. Thank You, Bob. There were two committee meeting tonight. Both the Environmental Planning Committee and the Finance Committee met to address items on their agenda.

Environmental Planning Committee Meeting
Chairman Kary called to order with the aid of Councilmen Bob Harrold and Councilman Dan Anderson. The goal was to address 3 EAS Reports.
FIRST EAS #1-2-19– the Partial rezoning of PERMANENT PARCEL NUMBER
#27A-006-0-00-038-0 currently zoned R-100 fronting on SOM CenterRd. This rezoning will create TWO NEW PARCELS of .2019 acres which will be zoned R-60 and front on Willow Creek Place.
After reviewing all the EAS reports on this project from our directors it is evident that this lot split in a logical decision and will present no issues whatsoever for the Environmental Planning Committee.
The representative for this property owner was asked by the Chairman if he would ask the property owner if he would consider installing the sidewalk in the front of his property on SOM Center Road. The representative shared he would convey the request of the Committee. It was emphasized that this was just a request and not a requirement.
It was recommended that this EAS move forward with approval and the understanding that the property owner will be asked to install the requested sidewalk on SOM Center Road.
SECOND EAS #2-2-19 - The proposed project is for a 3,240 sq. ft. single story Community Building for the existing 384 unit Willow Grove apartments located at 37411 Grove Avenue. A 900 sq. ft. outdoor swimming pool will also be added.
The representative shared that
· Construction will start approximately March 25th, 2019 and run thru July 15th, 2019, Correct?
· Mr. Sayles our City Engineer shared that the existing Sanitary Sewers can handle this development. There is a need for more storm-water mitigation in the area
· Chief Building Official, Mr. Darryl Keller shared that there is NO NEED for any Zoning Concerns since the clubhouse and the pool meets the zoning requirements for the Apartment Complex.
· It was recommended moving this EAS on to Planning Commission for review with the recommendation to assess the Storm-water mitigation.
FINALLY EAS #3-2-19- The proposed project is for the removal of approximately 10.1 acres of trees that are obstructing the approach of Runway 10 at Lost Nation RoadAirport. All this work is taking place on Private Property on the North and South side of Aquarius Parkway.
Patty Fulop, the Airport manager represented the Airport in the EAS.
· According to the EAS, the only concerns and recommendations come from our City Engineer, Mr. Sayles.
o Any work to be done in this area that is BEYOND the tree cutting and clearing “a wetlands delineation” must be done prior to that work
o The contractor must install silt protection for the inlet basins on Aquarius Pkwy and on Lost Nation Road if need be to protect for the MUD being tracked into the streets.
· The approval of EAS 3-2-19 was recommended to Council for passage this evening. The primary concern was to comply with all the required regulations to comply with the EPA and the removal of the trees as required by the Airport on these private properties.
Finance Committee Meeting
• The Finance Committee Meeting is convened to discuss the 2019 Budget.
· The Primary purpose of the committee meeting, chaired by Councilman John Tomaselli, was to prepare council for the upcoming task of addressing the 2019 Budget.
· Councilman Tomaselli passed out to all of Council the 2019 Budget for the City of Willoughby to review prior to the Meeting in March.

• The general purpose of the Legislative Caucus meeting is to review and discuss the legislation on the Regular Council. More on the legislation covered later in this summary.

PUBLIC PORTION
· Council and the Administration were addressed by former Council President Jerry Ranally. Mr. Ranally congratulated Councilman Harrold on his service to the city and wished him well in his retirement from Council.
· He questioned Council and the Mayor on the plans to “explore” the possibility of a new Parking Garage and Apartments at the edge of the Todd Field. The mayor assured Mr. Ranally that this is still in the exploration stage and as it moves ahead there will be an opportunity for the residents of the city to “weigh in”. It was also mentioned that if this project moves forward there will not be the use of Public Funds. The developers would fund the project. In closing, he asked about the Willoughby Union Development, and the Mayor shared that the main building project has met some wall and that the city is seeking out other developers at this time. There seems to be a great deal of interest in the property and its development.

RESOLUTION NO. 2019-7
A resolution authorizing the Director of Public Service to prepare plans and specifications and to advertise for bids for the 2019 Highway Pavement Lane Marking Project, such amount to be expended from the Street Maintenance and Repair Fund.
Emphasis will be placed on a better quality of paint to be used so the striping is more dramatic and also lends itself to a better base for future painting. Main arteries and crosswalks will be done. No side streets.

RESOLUTION NO. 2019-8
A resolution authorizing the Director of Public Service to prepare specifications andtoadvertiseforbidsforthe2019VoluntarySidewalkProgramwithaone-(1-) year renewaloption,said Program to provide for the repair and/or replacement of various sidewalks, curbing, driveway aprons, and pavement sections within theCity. These are sidewalks that are usually required to be repaired during the “point of sale inspections”. If any resident wants to replace, repair, or install a sidewalk they too may contact the city for a bid on the cost using the cities contractor doing the Sidewalk program.

RESOLUTION NO. 2019-9
A resolution authorizing the Mayor to accept a Community Development Block Grant for the FY 2018 through the Lake Country Office ofPlanning and Community Development in an amount not to exceed $35,160 to be used for Osborne Park Improvements.
That the Mayor is further authorized to execute any and all additional documents and forms necessary to properly secure and administer the grant.
This grant money will be used at Osborne Park to purchase:
Exercise equipment & install $24,000
Electric Service $12,000
Park Benches $ 6,000

RESOLUTION NO. 2019-10
A resolution expressing an intent to sell the unneeded, obsolete, or unfit property by internet auction and establishing a procedure for conducting the sale.
The City has and will have in the future, personal property acquired for the use of municipal officers and departments, including motor vehicles, road machinery, equipment, tools, or supplies which are not needed for public use, or are obsolete, or unfit for the use for which it was acquired; and
WHEREAS, Ohio Revised Code 721.15 sets forth the authority and procedures to sell at internet auction;
That the sale by internet auction shall be conducted according to the following procedure.
1) The Mayor of the City shall determine the internet website on which the sale shall beconducted.
2) The City shall conduct the auction via an internet auctionwebsite.
3) The City shall publish in a newspaper of general circulation a Notice of the City's intent to sell unneeded, obsolete, or unfit municipal personal property by internet auction.
4) The second Notice shall be published not less than ten (10), nor more than twenty (20), days after the publication of the firstnotice.
5) The Notice shall also be posted continually throughout the calendar year at City Hall and on the City website atwww.willoughbyohio.com.
6) The items to be auctioned will be posted on the City website, social media pages, and at City Hall ten (10) days prior to the start of theauction,
7) Items posted for auction can be visually inspected, where the item is located, at scheduledtimes.
8) A minimum bid may be set for anyitem.
9) Acompletedescription ofeachitemwillbeprovidedontheauctionlisting.
10) Bidders will have ten (10) days (including weekends and holidays) from the date the Notice of sale is posted on the internet website to submit abid.
11) The property will be sold to the highest bidder, where bid meets or exceeds the stated minimum bid. The successful bidder will be notified that its bid is accepted within 24 hours of the close of the auction period.
12) The successful bidder will deposit with the City ten percent (10%) of the bid price in cashier's check, certified check or money order within two (2) days after notification. Any funds remitted pursuant to the initial deposit shall be nonrefundable.
13) The balance of the bid price shall be paid by cashier's check, certified check or money order within ten (10) days of the notification. No item will be made available for shipping to the purchaser prior to the purchaser's obligation being satisfied infull.
14) Contact will be made with the successful bidder to discuss matters involving title transfer, if applicable, payment, and delivery of the item to the purchaser. All communication with the successful bidder shall be in writing and delivered to the address provided by the bidder with itsbid.
15) Arrangement and costs associated with the delivery of the item to the successful bidder shall be the sole responsibility of the purchaser. Risk of loss will be transferred to the successful bidder upon the tendering of the item to the successful bidder or its employees oragents.
16) All items are sold without warranty in "AS IS" condition. All advertisements, listings, and notices shall contain the followinglanguage:

RESOLUTION NO. 2019-11
A resolution approving EAS #3-2-19 for the removal of approximately 10.1 acres of trees located on private properties on the north and south sides of Aquarius Parkway.
The application which is the subject of this Resolution has been submitted and considered by this Council, pursuant to Chapter 1345 of the Codified Ordinances of the City of Willoughby;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WILLOUGHBY, THE COUNTY OF LAKE, AND THE STATE OFOHIO:
SECTION 1. That the application submitted by Patty Fulop, Lost Nation Airport Manager, for the removalofapproximately10.1acres oftreeslocated onprivatepropertiesonthenorthandsouth sides of Aquarius Parkway is approved, and the Council hereby determines that, based on environmental considerations, such project shall be allowed to commence or be constructed subjecttocompliancewithallapplicable ordinancesandregulationsoftheCityofWilloughby and statutes of the State ofOhio.

RESOLUTION NO. 2019-12
A resolution authorizing the Mayor to submit a loan application and enter into a loan agreement with the Ohio Environmental Protection Agency, Division of Environmental and Financial Assistance, and the Ohio Water Development Authority, through the Water Pollution Control Loan Fund (WPCLF) for planning, design and/or construction of the E. 364th, E. 365th and Harvard Dr. Storm Sewer Replacement Project; designating a dedicated repayment source for the loan.
The City of Willoughby has completed the planning and design of the East 364th, East 365th, and Harvard Dr. Storm Sewer Replacement Project; and
WHEREAS, the City of Willoughby seeks to replace the existing aforementioned storm-water facilities; and
WHEREAS, the City of Willoughby intends to apply for a WPCLF construction loan to repay itselfforadvancingfundsfortheplanninganddesignoftheaforementionedimprovementsand to assist the City to pay for the construction of the aforementioned storm-water facilities improvements;and
WHEREAS, the City of Willoughby has agreed on a time schedule with the Ohio EPA for the construction of said storm-water facilities improvements; and
WHEREAS,theOhioWaterPollutionControlLoanFundrequires thegovernmentauthorityto pass legislation for application for a loan and the execution of an agreement, as well as the designation of a dedicated repaymentsource(s);
NOW,THEREFORE,BEITRESOLVEDBYTHECOUNCILOFTHECITYOFWILLOUGHBY, THE COUNTY OF LAKE, AND THE STATE OFOHIO:
SECTION 1. That the Mayor is hereby authorized to file an application and enter into a loan agreementforaWaterPollutionControlLoanFund(WPCLF)loanwiththeOhioEnvironmental Protection Agency (OEPA), Division of Environmental and Financial Assistance, and the Ohio Water Development Authority (OWDA) for funding necessary to the planning, design and/or construction of the East 364th, East365th and Harvard Dr. Storm Sewer Replacement Project on behalf of the City of Willoughby, Ohio.
SECTION 2. That the Council and Administration of the City of Willoughby hereby designate sewer user fee revenue for a dedicated source of repayment to the Ohio Environmental Protection Agency, Division of Environmental and Financial Assistance, through the Water Pollution Control Loan Fund for the aforementioned improvements.
SECTION 3. That, if approved, the Mayor is hereby authorized to execute any and all documentationthatmayberequiredbytheOhioEPAandtheOWDAtosecureandadminister a WPCLF Cooperative Agreement for a loan for the purpose statedtherein.
SECTION4.ThattheCouncilandAdministrationoftheCityofWilloughbyherebyrequestthat theOhioEnvironmentalProtectionAgency,DivisionofEnvironmentalandFinancialAssistance, through the Water Pollution Control Loan Fund, consider and fund itsapplication.
This legislation authorizes the Mayor to submit an application and to enter into an agreement with the Ohio EPA for a WPCLF low interest(2.17%) loan for the project. The legislation also certifies that the sanitary sewer fund is to be used as the guarantee for the loan. This is the same as we have done on the previous WPCLF loans. The loan payments will be covered by the stormwater money allocated for Willoughby by the Lake County Storm Water Agency.
The E.364th, E.365th, and Harvard Drive Storm Sewer Replacement project is part of our continuing Storm Water Master Plan. The estimated construction cost is $1,860,000. The project will replace the storm sewers on the three streets noted as well as divert some flow away from the Stevens Blvd. drainage area. We anticipate opening bids in June.

An ordinance amending Chapter 1335 of the Codified Ordinances of the City of Willoughby, Ohio, titled, "Permit and Inspection Fees".

REPORTS FROM THE DIRECTORS, MAYOR, AND COUNCIL MEMBERS
Mayor:
The Mayor spoke briefly about the land clearing across from the Airport and thanked the Environmental Planning Committee and Council for getting this approved tonight so that the work may start back up again. There is a time crunch in getting the trees cleared because of the requirement set on land clearing and protection of the bats.

Judean commented to all thanking for the help in the acquisition of the grant mentioned above to be used at Osborne Park.
COMMENTS BY COUNCILMAN KARY
These comments may or may not be related to what took place at the Council Meeting
· I am still working on research regarding a traffic signal at the intersection of Hodgson Road and Lost Nation Road. I have been in communication with the County Commissioners and specifically Commissioner John Hamercheck. We have had some very positive conversations. Nothing that I can share at this time other than I am doing a great deal of research. More on this as we move to spring. The “big” issue is MONEY, and I am looking at several resources.
· I am planning a meeting with residents off North Bay that live on Kyle Cove to discuss the 2019 work to complete the storm-water mitigation in that specific area in and around Ward Creek.
· I have started the work to get all the “burned out” street lights back on along Lost Nation Road, near the Airport.
· I am also pushing the replacement of missing street lights on Lost Nation Road in Ward 2. There are at least 3 street lights that are missing and I will continue to work to get those replaced.
· I have spent a good deal of time working with the Council and the Planning Commission to complete the updates to the Planning and Zoning Codes for the City of Willoughby. We are making progress and many of the updates are all better for the city and its residents.
· I have done some homework looking at the possibility of securing some stops for Laketran on Lost Nation Road. Local Route 3 travels in our general area but completely ignores Lost Nation Road. This route travels from Lakeland Community College along 306 to Lakeshore to Shoregate and beyond. I am sure there are residents that could benefit from this Route. It would be nice if our residents had the opportunity to use this resource. This is now in the hands of Laketran as they study my proposal.
