December 18th, 2018
Tonight’s Council Meeting ………Let me start by sharing some information from our Finance Director regarding legislation that came in front of the Council. This will be a strong preface for all the financial information presented in this summary.
There are a number of items on the agenda for Tuesday. For the most part, they are required year-end business, including certifying property tax amounts and rates, and minimum wage increases.
There is a request for temporary appropriations that allow us to continue to operate until we finalize budgets in March 2019.

· Two parties spoke this evening. Both shared their compliments to the new Administration and Council on a successful 2018. They also wished everyone a Merry Christmas and a Happy New Year. Both parties are looking forward to 2019.

NEW BUSINESS
RESOLUTION NO. 2018-149
A resolution accepting the amounts and rates as determined by the Budget Commission, authorizing the necessary tax levies, certifying same to the Lake County Auditor. This resolution deals with the change in the valuations for properties in Willoughby. We as a city need to certify the rates that are presented to us from the county.
RESOLUTION NO. 2018-150
A resolution authorizing the Director of Finance to transfer funds from the General Fund to Various Other Funds. This action is a request to move UP TO $1,350,000 in total to cover such items as funding the retirement fund, monies for the capital fund, and monies for the current debt the golf course is paying off for all the renovations done years back to the facilities.
RESOLUTION NO. 2018-151
A resolution authorizing the Director of Finance to transfer funds from the Special Assessment Bond Fund to the General Bond Fund.
These monies deal with the final settlement of the Riverside Commons Development that has been in litigation for years. Soon this land may begin development again. Far too long of a battle.
ORDINANCE NO. 2018-152
An ordinance authorizing Amendment No. 2 to Ordinance No. 2018-38, the Manning & Payroll Ordinance, relative to the Department of Parks and Recreation, Service.
This ordinance deals with an increase in the minimum wage.
It addressed a 3% increase.
$8.30 to $8.55
RESOLUTION NO. 2018-153
A resolution authorizing expenditure in the amount of $22,695.19 for the repairs of the Plains Road Pump Station Sewage Force Main, a joint facility of the Willoughby-Eastlake Water Pollution Control Center.
SECTION 1. That an expenditure in the amount of $22,695.19 for the repairs of the Plains Road Pump Station Sewage Force Main and as directed by the Joint Agreement between the City of Willoughby and the City of Eastlake, specifically Section 5, Part C, Paragraph 4 Withdrawal of Funds, as amended on November 25, 1992, is hereby authorized and approved; such expenditure to be made from the WPCC Replacement Fund.
SECTION 2. That the Clerk of Council is hereby authorized and directed to transmit a certified copy of this Resolution to the Clerk of Council, City of Eastlake, Eastlake City Hall, 35150 Lakeshore Boulevard, Eastlake, OH 44095.
ORDINANCE NO. 2018-154
An ordinance amending Article III of the Charter of the City of Willoughby, Ohio, titled, "The Council" ;specifically, Section 1, titled, "Powers, Number, and Terms".
WHEREAS, the majority of the electors of the City of Willoughby at the General Election of November 6, 2018, and by popular vote approved an amendment to the City of Willoughby Charter, Article No. Ill, titled, "The Council", specifically, Section 1, titled, "Powers, Number, and Terms".
SECTION1. POWERS, NUMBER, AND TERMS.
All the legislative powers of the City of Willoughby, except as limited by this CharterandtheConstitutionand Laws oftheStateofOhio, shallbevestedinaCouncil of seven (7) members of which one (1) member shall be elected at large and six (6) members of which shall be elected from wards, one from eachward.
NOTE: in the following text if you see two words that conflict or two numbers that conflict, then you need to understand that the BOLD AND ITALICIZED WORDS OR NUMBER ARE THE CORRECTED VERSION.
EXAMPLE:
on the second first day of January following the member's election
The term of office of each member is to be two (2) years and shall commence on the second first day of January following the member's election....
ORDINANCE NO. 2018-155
An ordinance amending Article III of the Charter of the City of Willoughby, Ohio, titled, "The Council"; specifically, Section 5, titled, "President of Council".
WHEREAS, the majority of the electors of the City of Willoughby at the General Election of November 6, 2018, and by popular vote approved an amendment to the City of Willoughby Charter, Article No. Ill, titled, "TheCouncil", specifically, Section 5, titled, "President of Council".
SECTION 1. That Article Ill of the Charter of the City of Willoughby, Ohio, titled, ''The Council"; specifically, Section 5, titled, "President of Council", is hereby amended to read and provide as follows:
SECTION5. PRESIDENT OFCOUNCIL.
The Council at its first meeting in January of each year shall elect a President of Council and Vice President of Council from among its own members, who shall serve for one (1) year and shall have all the powers, duties, obligations and rights of any other member of Council, and, in addition thereto, the President of Council shall preside at all meetings of Council and when the Mayor is unable for any cause to perform the duties of Mayor, the President of Council shall become the acting Mayor and, during such period, shall have the same powers and perform the same duties as the Mayor.
The Vice President of Council shall have the authority to perform the duties of the President of Council in the absence of the President of Council.
ORDINANCE NO. 2018-156
An ordinance amending Article IV of the Charter of the City of Willoughby, Ohio, titled, "The Mayor"; specifically, Section 1, titled, "Term".
WHEREAS,the majority of the electors of the City of Willoughby at the General Election of November 6, 2018, and by popular vote approved an amendment to the City of Willoughby Charter, Article No. IV, titled, "The Mayor", specifically, Section 1, titled, "Term".
SECTION 1. That Article IV of the Charter of the City of Willoughby, Ohio, titled, "The Mayor"; specifically, Section 1 titled, "Term", is hereby amended to read and provide as follows:
SECTION1. TERM.
The Mayor shall be elected for a term of four (4) years commencing January 2, 2002, and shall commence and assume office on the second first day of January following his election, and shall serve until death, disqualification, removal,orresignation, or until a successor is elected and qualified.
ORDINANCE NO. 2018-157
An ordinance repealing Article VI of the Charter of the City of Willoughby, Ohio, titled, "Planning and Zoning"; specifically, Section 5, titled, "Construction".
WHEREAS, the majority of the electors of the City of Willoughby at the General Election of November 6, 2018, and by popular vote approved an amendment to the City of Willoughby Charter, Article No. VI, titled, "Planning and Zoning", specifically, Section 5, titled, "Construction".
SECTION 1. That Article VI of the Charter of the City of Willoughby, Ohio, titled, "Planning and Zoning"; specifically, Section 5, titled, "Construction", is hereby repealed.
RESOLUTION NO. 2018-158
A resolution approving and authorizing the Mayor of the City of Willoughby to submit an application to the Northeast Ohio Areawide Coordinating Agency to change the Facility Planning Area for the Laketran intermodal Transit Center at Lakeland Community College, from Lake County to the Willoughby-Eastlake Sewer District.
Lakeland Community College and Laketran approached Willoughby requesting a connection to the Willoughby Sanitary Sewer System on SR 306. The Service Department and Engineering reviewed the request and concluded that the downstream sewer system in Willoughby has the capacity to handle the less than 1,000 gallons per day flow rate. Allowing this connection saves Laketran the cost of installing a sewage pumping station and running the sanitary sewer into the main Lakeland campus. The connection to the Willoughby sewer is much shorter and can be done by gravity.
The complication is that the facility is located in the City of Kirtland and within the Facility Planning Boundary for the Lake County Gary Kron Water Reclamation Facility. These boundaries are set by the EPA. However, by making application to the Northeast Ohio Areawide Coordinating Agency (NOACA), Willoughby, Kirtland, and Lake County can get the boundary changed for cases like this. The EPA is fine with a change if it results in a more efficient way to dispose of wastewater, but they have a process and it starts with NOACA. The initial step is to request Willoughby Council to pass legislation to allow the Mayor to make this application.
RESOLUTION NO. 2018-159
A resolution authorizing a Tap-In to the Willoughby-Eastlake Sewer System for a portion of Permanent Parcel No. 20A0010000110 owned by Lakeland Community College in the City of Kirtland for the Laketran intermodal Transit Center Facility.
Resolution 2018-159, is a requirement within the WPCC agreement and amendments with the City of Eastlake for connections from outside the City. Neither City can allow someone to connect from outside the boundaries of Willoughby and Eastlake to the sewer tributary to the Willoughby-Eastlake Water Pollution Control Center without the consent of both Councils. When Lakeline connected to the Eastlake sewers both Councils had to pass similar legislation. Willoughby just last year had three homes in Mentor-on-the-Lake connect to Willoughby's sewer on Iroquois Trail. Both Councils passed legislation allowing those connections. Resolution 2018-159 is to allow Laketran to connect their Intermodal Transfer Station located in Kirtland to the Willoughby Sanitary Sewer System. Eastlake Council passed their legislation last Tuesday allowing the connection.
Resolution # 158 and 159 brought up a discussion by Councilman Kary asking Council and the Administration to explore the role of Laketran in Willoughby. There are routes but limited in scope. In fact on Lost Nation Road, it is virtually impossible for a resident to use Laketran without walking to Lake-Shore Blvd. This to councilman Kary is unacceptable. He asked if we could negotiate with Laketran that in exchange for our helping them out both physically and financially with the Bus Station they are proposing that we ask for some Laketran runs on Lost Nation Road, and possible elsewhere. This was met with favorable support from the Council and the Administration and the idea will be pursued by the Administration. Councilman Kary’s goal is to create a route that comes in on Hodgson from SR 306 traveling West to Lost Nation Road, then turning south to Adkins Road then East again on Adkins back to SR 306. This Lost Nation Loop will create a run for Lost Nation Road that currently does not exist. Many of our residents in the area would then have easier access to Laketran and its routes. This route alone could serve Lakeland Community College easily!!!

A resolution amending Resolution No. 2018-40 to provide for current expenses and other expenditures of the City of Willoughby, Ohio, during the period ending December 31, 2018.
That to provide for current expenses and other expenditures of the City of Willoughby, Ohio, during the period ending December 31, 2018, the following sums totaling $62,387,264.00 are hereby set aside and appropriated from the funds.

RESOLUTION NO. 2018-162
A resolution authorizing temporaryappropriations totaling $15,649,945 for current expenses and other expenditures of the City of Willoughby, Ohio, during the period ending March 31, 2019.
Provide for current expenses and other expenditures of the City of Willoughby, Ohio, during the period ending March 31, 2019, the following sums totaling
$15,649,945 are hereby set aside and appropriated from the funds. Since our Final Annual budget is not due till March 2019, we will operate on a temporary. Our annual total budget is about $60 million dollars. Our operating budget about $30 million.

o The mayor thanked the Chiefs, all the Directors, and the employees of Willoughby for making his first year as mayor a successful 2018. He also thanked Council as well for working together to contribute to a successful 2018.

o Mr. Bock shared that the LEAF PICKUP IS COMPLETED!!!

o Mr. Sayles shared that there still will be some road striping going on.

o Chief Ungar shared that 2018 was a good year and he was pleased to be part of a smooth transition in the Administration.

o Chief Beckwith echoed Chief Ungar’s remarks to both the Administration and Council.

o Wished all a very Merry Christmas

o Judean shared that the Senior Center is close to being done, BUT it will still not open till the other facilities around them are complete.

o Wished all a Merry Christmas and also shared she was looking forward to 2019. She also hinted that her family will all be here in town for the Holidays and that she was looking forward too.
